The sheet for the waiver process says that “a waiver is nothing more than an agreement that the charges be forwarded to the Court of Common Pleas for further proceedings.”
It may be much more than that, in our view. If you waive, you generally give up your right before trial to test the sufficiency of the evidence against you—and size up the witnesses against you.
Which a big deal in a contested case. But not so much in most ARD eligible cases. You have to waiver your prelim to be ARD eligible.
